Terms & Conditions

The conditions set out here constitute my terms of sale. Please contact me for clarity on any matter which is not clear or do not understand and note that nothing contained here affects your statutory rights as a consumer.


Cakes

Our photographs are an accurate representation of my cakes, however as each cake is a handmade “one off” creation details may vary and colours may not be exactly as shown.

 

Please note that when ordering a cake using one of my photos as reference, that the size of the cake may alter the proportions – smaller cakes appear deeper than larger cakes etc.

Cake Cancellations


14 working days or more - reschedule or credit
14 working days or less – no credit /  possible reschedule
Less than 48 hours notice – no credit or rescheduling
Please note that orders placed without giving enough notice may not be delivered/ready for collection on time

 

Allergy Information

 

Our Cakes are made fresh and are 'non pre-packaged'. Unless otherwise specified all The Merry Baker’s cakes may contain;
 

  • EGGS

  • WHEAT/ CEREALS CONTAINING GLUTEN

  • MILK

  • NUTS

  • SOYA

  • SULPHITES (found in dried fruit)
     

It is the customer’s responsibility to make The Merry Baker aware of any special dietary requirements that need to be accommodated in the making of their cake.

The Merry Baker accepts no liability for anyone suffering allergic reactions from eating our cakes unless prior advice is given by the customer of any allergies when ordering the cake.

Timescales


I will endeavour to do everything I can to accommodate your order however I work to a maximum number of cakes per week and will not compromise.
 



Customer Satisfaction Guarantee

In the unlikely event there is an issue with your cake, it must be brought to our attention within 24 hours of the cake being collected so we can be given the opportunity to asses the nature of the problem. We would take any complaints very seriously.
 

If the complaint is regarding the design of the cake, but the cake was made according to the order form, we cannot be held responsible for any errors not picked up by the customer.

If the complaint is regarding the quality of the cake, we may ask for the cake or the remainder of the cake to be returned to us within 48 hours of delivery for inspection.

 


For any complaints we can only deal with the person who booked the cake originally.


You must give us an opportunity to resolve the issue and agree not to post any defamatory comments or pictures on online forums or social media channels before discussing the situation with us and allowing us reasonable time to provide a satisfactory solution.


Once a solution has been reached, you agree not to post any defamatory comments or pictures on online forums or social media at any point in the future. If this happens, we may seek to take legal action against you.


The maximum refund I offer is the value of the cake. Further compensation is not available. All deposits/booking retainer fees are non-refundable. 

 


 

Liability

My liability to you is limited to the price of the cake and The Merry Baker cannot be held responsible for any indirect losses which may happen as a consequence of any breach by me of these terms however arising. However, this does not include or limit in any way The Merry Baker’s liability for any matter for which it would be illegal for me to exclude, or attempt to exclude.

 


 

Events Outside Our Control

The Merry Baker cannot be liable or responsible for any failure to perform or delay in performance of, any of my obligations under these terms that are caused by any act, event, non-happening, omission or accident beyond my reasonable control.
 


Check your order


While I take every measure possible to check orders it is also the responsibility of the customer to make sure the details on the order form are accurate. While I will do everything I can to rectify the situation when an error is made, i.e. wrong date, then the responsibility lies with the customer to check the details.

 


 

Deposits and Payments

A booking fee is required to confirm your order and save your date (a minimum of £100 for wedding and a minimum of £25 for all other cakes) this is non-transferable and non-refundable. The order is confirmed on receipt of the booking fee and no guarantees can be given on availability until the booking fee has been paid. If your booking fee is not paid within 14 days of quoting then I reserve the right to cancel any previous arrangements. Balances for wedding cakes are due in full 14 days before the wedding and for all other cakes payment will be cash in full on collection or by electronic/bank transfer in full received prior to collection.  Please note there is no credit available and cakes will not be given until payment is made.


 

Collection

Your order may be collected on the date ordered. Cakes that are collected by the customer are always boxed for transportation. We will provide guidance on the care and handling of your cake. Photographic evidence will be taken to confirm that you have received your order in perfect condition and as specified.
As you will appreciate, once a cake leaves The Merry Baker, responsibility then passes to the customer and The Merry Baker is not liable for any damage that may occur to the cake once it has left us.
Please be aware that we advise cakes be placed on a level, steady surface for transport e.g., in the boot of your car or in the passenger footwell (ensuring that the car heater is turned off). Never put your cake on the passenger seat or on a passengers lap. The cake should then be stored in the box at room temperature and out of direct sunlight. If you are unsure, please ask.

Delivery

When a cake is to be delivered it remains the responsibility of The Merry Baker while in transit. Where any damage occurs then it is the sole responsibility of The Merry Baker to make good any damage. If this is not possible, for whatever reason, then a full refund will be given.

Delivery and setup is £35 if within a 10 mile radius of PA5 9AJ. If outwith this radius there is an additional £0.50p per mile round trip charge on top.




Best Before Dates

When preparing some cakes, especially larger ones, the cakes need to be in prep for two, sometimes three days before the event. While I do everything to ensure that the cake is as fresh as possible for the event, the best before dates are usually within two days of the event. To assist in prolonging the shelf life the cakes are best placed in a sealed container (this will damage a sugar paste finish) in the fridge. I do not accept liability for consumption from two days following the event.

 


 

Non-Edible Decorations

Sometimes our cakes will contain non-edible elements such as plastic dowels, flowers, or cake toppers. We will advise you of any non-edible elements that need to be removed during cutting.

As we will not personally be cutting the cake, we cannot accept any responsibility for any non-edible elements not removed prior to serving.

If flowers are provided from an outside source you acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt or other contaminants.


During the design process, the customer will be informed of any non-edible decoration that will be used to construct the cake. The customer must relay this information to the venue/hosts.

 

 


Copyright

The design copyright is the property of The Merry Baker. The customer does not have any claim on the design. The Merry Baker reserves the right to use images of any design for promotional purposes following the event.
 

 

COVID Restrictions

If your cake booking has to be amended due to COVID restrictions, we will try our best to be accommodating and flexible.

If you need to postpone your booking because your event date falls under a period of Government restrictions for COVID, e.g., a national lockdown or Tier 3 / Tier 4 restrictions then as long as we are free on your new date, we will move the deposit paid across to the new date for you subject to the conditions below.

If we can change your event date, provided it is within 6 months from the day you request the date change, the deposit will be transferred to the new date.

If we are not able to accommodate your date change request, the original deposit will be refunded. This is only when the event can no longer go ahead because of COVID restrictions.

If you are moving to a date further ahead than 6 months from the day you request the date change, a new deposit/booking fee of £25 will be payable on top of the original deposit/booking fee, but both booking fees will come off the final cost.

If you decide to cancel your event as you are worried about future COVID restrictions, but restrictions are not currently in place for your event date, it will be treated as a standard cancellation.




Revisions

I have the right to revise and amend these terms and conditions. However, you will be subject to the terms and conditions in force at the time that you place your order with me.
